1. Agreement to Terms

By inviting FalconX to your Discord server or using any of its features, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use FalconX.

These Terms constitute a legally binding agreement between you and FalconX. Your use of the bot indicates your acceptance of these Terms.

2. Description of Service

FalconX is a Discord bot that provides the following services:

• Server moderation tools (kick, ban, message management)
• Role management and assignment
• Server utilities and information commands
• Entertainment and fun features
• Giveaway management
• Server logging and tracking
• Custom welcome/leave messages

We reserve the right to modify, suspend, or discontinue any feature at any time without notice.

3. Eligibility

To use FalconX, you must:

• Have a valid Discord account in good standing
• Have the necessary permissions to add bots to your Discord server

• Use the bot for automated or excessive requests (botting)
• Share or distribute illegal, harmful, or offensive content
• Impersonate others or misrepresent your affiliation
• Use the bot in servers that violate Discord's Terms of Service
• Resell or redistribute bot services without authorization

5. User Responsibilities

As a user of FalconX, you are responsible for:

• Maintaining the security of your Discord account
• All activities that occur under your account
• Ensuring your use complies with these Terms
• Properly configuring bot permissions in your server
• Monitoring bot usage by your server members
• Reporting bugs, vulnerabilities, or abuse to us

6. Server Administrator Responsibilities

If you invite FalconX to a server you manage, you additionally agree to:

• Ensure server members comply with these Terms
• Configure appropriate role permissions for the bot
• Use moderation features responsibly and fairly
• Not hold FalconX liable for actions taken by server members
• Respect Discord's API rate limits and terms

7. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. By using FalconX, you consent to our data practices as described in the Privacy Policy.

8. Intellectual Property

All intellectual property rights in FalconX, including but not limited to:

are owned by FalconX or its licensors. You may not copy, modify, distribute, sell, or lease any part of our services without explicit written permission.

9. Third-Party Services

FalconX integrates with and relies on third-party services:

• Discord: Subject to Discord's Terms of Service
• External APIs: Weather, jokes, images, and other data providers
• Hosting Services: For bot infrastructure

We are not responsible for the availability, accuracy, or policies of these third-party services.

10. Service Availability

While we strive for maximum uptime:

• We do not guarantee uninterrupted service
• Maintenance and updates may cause temporary downtime
• We reserve the right to modify or discontinue features
• Service may be suspended for violations of these Terms

We aim for 99.9% uptime but cannot be held liable for service interruptions.

11. Disclaimers and Limitations of Liability

FalconX is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability

11.2 Limitation of Liability

To the maximum extent permitted by law, FalconX and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or errors
• Actions taken by users using the bot
• Third-party content or services

12. Indemnification

You agree to indemnify, defend, and hold harmless FalconX, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of FalconX
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

13. Termination

13.1 Termination by You

You may stop using FalconX at any time by removing the bot from your server.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to FalconX at any time, with or without notice, for:

• Violation of these Terms
• Abusive or harmful behavior
• Legal or regulatory requirements
• Security or technical reasons

13.3 Effect of Termination

Upon termination:

• Your right to use FalconX immediately ceases
• Server data may be deleted within 30 days
• Provisions that should survive termination will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon:

• Posting the updated Terms with a new "Last Updated" date
• Notification through our support server
• Continued use of FalconX after changes constitutes acceptance

Material changes will be announced with at least 30 days' notice when possible.

15. Dispute Resolution

Before filing any formal dispute, you agree to contact us through our support server to attempt to resolve the issue informally.

15.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and not as part of any class or representative action.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FalconX operates, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FalconX regarding the use of the bot and supersede all prior agreements and understandings.
